Construction of waste incineration plant in Bydgoszcz can continue

On 26 March 2014 the Voivodship Administrative Court in Bydgoszcz dismissed appeals filed by three environmental organisations against a permit to construct a waste incineration plant in Bydgoszcz. The investor is Międzygminny Kompleks Unieszkodliwiania Odpadów ProNatura sp. z o.o. in Bydgoszcz, and the investor’s contractor is the consortium ASTER Astaldi S.p.A, TM.E. S.p.A. and Termomeccanica Ecologia s.c.

The aim of the venture is to comprehensively regularise the management of mixed municipal waste in the Bydgoszcz-Toruń Metropolitan Area. The installation’s planned capacity is 180 thousand tonnes of waste per year. The value of the investment is approx. PLN 535 million, including EU funding of PLN 261.7 million in the form of a grant from the Cohesion Fund.

If the court had upheld the appeals filed by the environmental organisations, there would have been a risk of the investment having to be stopped, which would have meant that the EU funding could have been lost.

DZP was adviser to the investor and the contractor in the proceedings before the Voivodship Administrative Court in Bydgoszcz. The lawyers engaged in the advisory were Daniel Chojnacki, Counsel, and Maciej Białek, Associate, in the Environmental Team of DZP’s Infrastructure and Energy Practice.
