Public procurement

We advise both contractors and contracting parties at all stages of contract award, PPP and concession procedures and during contract performance.

  • analyses of the legal structures of complex investment undertakings carried out under public contracts, PPP, concessions, and other forms of public-private cooperation,
  • analyses of potential breaches of law in carrying out undertakings based on public-private cooperation, including in-house,
  • assistance with developing procedure participation strategies,
  • identifying and eliminating risks associated with procedures and performance of contracts,
  • formal legal support at all stages of procedures (drawing up the tender documentation required for a procedure and responding to contracting party requests),
  • applying legal remedies, representation before the National Appeal Chamber and in court,
  • advice during public, PPP and concession contract performance (e.g. as regards permitted amendments to contracts),
  • advice on concluding and performing agreements with consortium partners, subcontractors and other business partners,
  • assessing procurement risks in M&A and enterprise restructuring transactions,
  • full-range analyses and legal advice on interpreting Public Procurement Law regulations and other related acts, including draft regulations during legislative work,
  • public procurement compliance, particularly identifying and eliminating risks (e.g. of a contractor being excluded from a tender procedure).
