Emerging issues in licensing and enforcement of Standard Essential Patents

Standard essential patents (SEP) cover LTE, 5G, Wi-Fi and DVB technologies. Access to these standards on fair, reasonable and non-discriminatory (FRAND) terms is one of the key factors driving development in new technology industries.

The European Commission, in response to the need for effective and predictable licensing of SEPs, announced on 27 April 2023 a draft regulation on standard essential patents, around which legal discussions are currently taking place.

One of these is a conference “Emerging issues in licensing and enforcement of Standard Essential Patents” organised by the Institute of Legal Studies at the Polish Academy of Sciences and the Law and Administration Faculty at Adam Mickiewicz University in Poznań, which will be held on 7-8 September. At the event, held, inter alia, under the auspices of the New Technologies Law Association, experts will look at the solutions proposed by the European Commission and discuss current problems with SEP licensing and enforcement.

Michał Nita, Associate in the IP&TMT Practice, will participate in a discussion on SEP litigation in key jurisdictions, including before the Unified Patent Court.

The conference will take place onsite at Staszic Palace in Warsaw at ul. Nowy Świat 72 and online.
