Advisory to OEC re: the construction of broadband networks

DZP is providing legal advisory to the Office of Electronic Communications (OEC) on developing its broadband market and carrying out an investment involving the construction of broadband networks.

During the project we advised on, e.g. issues related to the municipality’s investment in broadband networks as part of general economic interest services and developing a claw-back mechanism to control profit level. Our advisory also covered procedures and potential ways of implementing the broadband network investment (public procurement, concession, PPP).

DZP also took part in the process to develop system-based solutions for the purpose of the Act on Supporting the Development of Telecommunication Services and Networks in the context of potential ways and means of carrying out local authority tasks and state aid.

The project is being carried out by the Infrastructure and Energy Practice and is led by Marcin Krakowiak.
