DZP advises OHL group on construction of Trasa Słowackiego in Gdańsk

28.02.2013

DZP's Infrastructure & Energy Practice advised the company Obrascon Huarte Lain S.A. on an investment entitled "Construction of a road link between Gdańsk Airport and the Port of Gdańsk – Trasa Słowackiego, Task II, ul. Potokowa-Al. Rzeczpospolita Section" in performance of part of a contract with the City of Gdańsk. The project has been completed and the work accepted by the contracting entity.

Our work covered advising on relations with the contracting entity, with other consortium members (PBG S.A., Aprivia S.A., Hydrobudowa Polska S.A.) and with subcontractors. The services also covered bankruptcy advisory on the effect of petitions in bankruptcy filed by some consortium members on further investment implementation. The project was complex as three of the fourconsortium members had filed for bankruptcy (the only company that had not filed for bankruptcy was Obrascon Huarte Lain S.A ) and the work had to be continued. Project value in excess of PLN 159 million.

The Infrastructure & Energy Practice is also advising Obrascon Huarte Lain S.A. on carrying out the next stage of the investment: "Construction of a road link between Gdańsk Airport with the Port of Gdańsk – Trasa Słowackiego, Task IV, Marynarka Polska Interchange-Ku Ujściu Interchange Section". The outcome of this project will be a road tunnel under the Martwa Wisła river constructed by using a tunnel-boring machine (TBM). Project value in excess of PLN 885 million with completion expected in 2014. In addition, during project implementation the composition of the consortium changed due to the bankruptcy of three of the fiveconsortium members.

"Advising OHL S.A., an international construction firm operating in 30 countries and on 5 continents, is another key project for our Practice in the field of road and bridge infrastructure. Well-grounded knowledge and unique experience is key in projects of this type" said Marcin Krakowiak, Head of DZP's Infrastructure & Energy Practice.

Both projects were carried out by Infrastructure & Energy Practice experts Tomasz DarowskiKatarzyna KuźmaEmilia Dąbrowska andJose Luis Villacampa, with the support of Igor Barcew from the Corporate and M&A Practice responsible for bankruptcy law aspects.
