DZP wins prominent real estate case over terminal in Świecko for Słubicki Province

DZP's advice to Słubicki Province has brought double success in a prominent case over the terminal in Świecko (the former Customs Clearance Freight Terminal) that the Province acquired from the State Treasury.

First, the Supreme Court, by way of two orders of 25 September 2014 (case nos. II CSK 721/13 and II CSK 722/13), followed by the Regional Court in Gorzów Wlkp., by way of two orders of 23 December 2014 (case nos. V Ca 569/14 and V Ca 570/14), finally and non-revisably upheld Słubicki Province's legal title to the terminal in Świecko.

Then the Supreme Administrative Court (after overturning the judgment of the Voivodship Administrative Court in Gorzów Wlkp.), by way of two judgments of 11 February 2015 (case nos. I OSK 2791/14 and I OSK 2792/14), finally and non-revisably dismissed Lubuskie Voivodship's appeal against resolutions adopted by the authorities of  Słubicki Province concerning development of the Świecko terminal real estate.

The history of the dispute over the terminal in Świecko dates back to the second half of 2011 and covers a number of inter-related civil and administrative proceedings dealing with complex and sometimes precedential issues relating to the management of public real estate (i.e. legal problems in the field of civil and administrative law in which DZP's Real Estate Practice is particularly specialised).
